【 용 례 】 점유자는 그 점유를 부정히 침탈 또는 방해하는 행위에 대하여 자력으로써 이를 방위할 수 있다 A possessor may defend, with his/her own force, his/her possession against any acts unjustly depriving him/her of his/her rightful possession or disturbing it.
【 용 례 】 자기 또는 타인의 법익에 대한 현재의 부당한 침해를 방위하기 위한 행위는 상당한 이유가 있는 때에는 벌하지 아니한다 An act which is performed in order to prevent impending and unjust infringement of one’s own or another person’s legal interest shall not be punishable if there are reasonable grounds for that act.
